Terms of Service

If you do not agree to these Terms, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) to use the Services. If you are under the age of majority where you live, you may only use the Services with the involvement of a parent or legal guardian who agrees to these Terms. Certain features (including paid Shard purchases) may have additional age or eligibility requirements.

Access to Studio, Nexus, Gen8, and related features may require signing in with AIR Kit or another authentication method we support. One login may unlock multiple Portal products under shared SSO. You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly at support@portalgaming.com if you suspect unauthorized access.

Portal provides a hub and tools for AI-assisted game creation, asset workflows, and related experiences. Features may be offered as early access, beta, or limited release and can change, throttle, or end without notice. Product-specific rules, event terms, or program guidelines may apply in addition to these Terms.

“Shards” are a prepaid digital balance used to access certain compute, generation, or product features across Portal apps. Shards have no cash value outside the Services, are not legal tender, and except where required by law are non-refundable and non-transferable. Purchases are processed by our payment provider (such as Stripe). Prices and pack contents may change. Abuse, chargebacks, or fraudulent payment activity may result in suspension and forfeiture of unused Shards to the extent permitted by law.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes. We and our licensors retain all rights, title, and interest in the Services, branding, software, models, and documentation.

You retain ownership of original game concepts, prompts, assets, and other content you create or upload (“User Content”), subject to third-party rights and model/provider terms that may apply to generated outputs. You grant Portal a worldwide, non-exclusive license to host, process, transmit, and display User Content as needed to operate the Services you request. You represent that you have the rights needed to provide User Content and that it does not violate law or others’ rights.

You agree not to:

• Use the Services unlawfully, or to create or distribute illegal, harmful, or infringing content.
• Attempt to disrupt, probe, or reverse engineer the Services except where permitted by law.
• Abuse authentication, scrape aggressively, circumvent rate limits, or interfere with other users.
• Misrepresent your identity or affiliation, or misuse another person’s account.
• Use the Services to train competing models in violation of applicable provider or Portal rules.

The Services may integrate third-party authentication, model providers, engines, payment processors, or links to external sites. Those services are governed by their own terms and privacy policies. Portal is not responsible for third-party services we do not control.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTAL DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED OUTPUTS MAY BE INACCURATE, INCOMPLETE, OR UNSUITABLE; YOU ARE RESPONSIBLE FOR REVIEWING RESULTS BEFORE RELYING ON THEM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTAL AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PORTAL FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

You will defend and indemnify Portal and its affiliates against claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, or your violation of these Terms or applicable law.

We may suspend or terminate access to the Services if you violate these Terms, create risk or legal exposure, or if we discontinue a product feature. You may stop using the Services at any time. Provisions that by their nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules. Courts of Hong Kong have exclusive jurisdiction over disputes arising from these Terms or the Services, except where mandatory consumer protections in your place of residence require otherwise.

We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Services.
